Arcade 51™ App Terms of Use

Applies to: the Arcade 51™ mobile app for Android and iOS. Use of the arcade51az.com website is covered by the website Terms of Service.

These Terms of Use ("Terms") are a binding agreement between you and Arcade 51 LLC ("Arcade 51", "we", "us") for the Arcade 51 mobile app (the "App") and the games, art, music, and other content in it. By downloading, installing, or using the App, you agree to these Terms and to the App Privacy Policy. If you do not agree, do not use the App.

1. License to use the App

Subject to these Terms, Arcade 51 LLC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App, and to play the games you are entitled to, on Apple or Android devices that you own or control, for your own personal, non-commercial entertainment. The App and its content are licensed, not sold. All rights not expressly granted are reserved by Arcade 51 LLC.

2. Free games and in-app purchases

• Free games. Some games are included free with the App. We may add, change, or retire free games at any time.
• Game unlocks. Other games can be unlocked with a one-time in-app purchase. The price is shown in the App before you buy (currently US $0.49 per game, or the local equivalent set by the app store, plus any tax). An unlock is a license to play that game in the App on devices signed in to the same Apple ID or Google account. It has no cash value and cannot be transferred, sold, or exchanged.
• Payment. Purchases are processed by Apple (App Store) or Google (Google Play) under their terms. We never see or store your payment card details.
• Restoring purchases. Use Settings → Restore purchases to restore unlocks on a new or reset device that uses the same store account.
• Refunds. Refund requests are handled by Apple or Google under their refund policies. Except where the law requires otherwise, we do not provide refunds directly. If a refund is issued, the related unlock may be removed.
• Changes. We may change prices and which games are offered. A price change does not affect games you have already unlocked. If we ever have to remove a game you paid for (for example, for legal or technical reasons), we will try to give you a reasonable replacement or tell you how to request a refund through the store, as the law and store rules require.
• Parents. If you are under the age of majority where you live, you may make purchases only with a parent's or guardian's permission. Parents can turn on purchase approval with Apple's Ask to Buy or Google Play's purchase authentication.

3. Leaderboards and gamer tags

If you choose to post scores, the App sends your gamer tag, the game, and your score to the Arcade 51 online leaderboards at arcade51az.com, where other people can see them. Use a gamer tag, never your real name. Do not use names that are offensive, hateful, harassing, adult, impersonating, misleading, or that belong to another Arcade 51 member. You grant Arcade 51 a worldwide, royalty-free permission to store, display, moderate, remove, and reset submitted gamer tags and scores to run the leaderboards and for fair play and promotion. We may remove entries and reset scores at any time. You can turn score posting off in Settings.

4. Fair play and prohibited uses

Unless Arcade 51 LLC gives you written permission, you may not:

• copy, extract, unpack, decompile, disassemble, or reverse engineer the App or any game, or try to obtain its source code, art, audio, or game files, except where the law expressly permits this despite this restriction;
• reproduce, re-upload, mirror, distribute, sell, rent, lend, sublicense, stream, or publicly display any game, game file, or other Arcade 51 content, or make it available in another app, website, or store;
• bypass, disable, or work around in-app purchases, unlocks, or other access controls, or use a modified, "cracked", or pirated copy of the App;
• cheat, use bots, scripts, or automation, manipulate game code or network requests, spoof scores, exploit bugs, or otherwise interfere with games, leaderboards, or our servers;
• create derivative works, fan games, mods, or merchandise based on Arcade 51 content for any commercial purpose;
• use any Arcade 51 content to train, fine-tune, test, or improve an artificial-intelligence or machine-learning system, to build datasets, or to generate imitations of our characters, art style, or games;
• use our names, logos, or characters in a way that suggests sponsorship or endorsement, or in any app name, domain name, or social media handle;
• use the App in violation of any law.

Brief quotations, screenshots, and gameplay clips used for genuine review, commentary, or news are not restricted where the law allows them as fair use. Fans are welcome to link to the App's store pages and to arcade51az.com.

5. Ownership and content protection

The App and all of its content, including the Arcade 51™ name and logo, all games, characters (including Kevin, Agents Gray and Black, and other Arcade 51 characters), stories, artwork, animation, music, sound, text, design, and code ("Arcade 51 Content"), are owned by Arcade 51 LLC or its licensors and are protected by United States and international copyright, trademark, and other laws. Arcade 51™ and related names and logos are trademarks of Arcade 51 LLC. Some art, music, and voices in our games were created with the help of AI tools under our direction, and they remain Arcade 51 Content.

6. Enforcement

If you violate Sections 1, 4, or 5, then, in addition to any other rights we have: your license ends immediately and automatically; we may disable your access to the App, leaderboards, and unlocks without refund (except where the law requires a refund); we may send takedown notices to app stores, websites, hosts, and platforms; and we may seek all remedies available under law, including injunctive relief, actual or statutory damages, and recovery of costs and attorneys' fees where the law allows. You agree that unauthorized copying or distribution of Arcade 51 Content would cause Arcade 51 LLC irreparable harm that money damages alone could not adequately remedy.

7. Copyright complaints (DMCA)

To report piracy of our games, or if you believe something in the App infringes your copyright, contact our designated agent: Arcade 51 LLC, Attn: Copyright Agent, 3335 W Dahlia Dr, Phoenix, AZ 85029 · (602) 332-7710 · 2bros@arcade51az.com (U.S. Copyright Office DMCA Directory registration no. DMCA-1083731). Notices must meet the requirements of 17 U.S.C. § 512.

8. Updates, availability, and changes

We may update the App, change or retire features and games, or stop offering the App. The App may need updates to keep working, and some features (such as leaderboards) need an internet connection. We may update these Terms. The updated Terms apply from their effective date, and your continued use of the App after that means you accept them.

9. Disclaimers

To the fullest extent allowed by law, the App and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free play, permanent storage of scores, or compatibility with every device.

10. Limitation of liability

To the fullest extent allowed by law, Arcade 51 LLC and its owners, creators, partners, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost data, lost scores, or lost profits. Where liability cannot be excluded, our total liability is limited to the amount you paid for the App or the in-app purchase giving rise to the claim in the twelve months before the claim, unless the law requires a higher amount. Some places do not allow these limits, so they may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Arcade 51 LLC from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the App, your violation of these Terms or the law, your submitted gamer tags, or your unauthorized copying or sharing of Arcade 51 Content.

12. Termination

These Terms apply until ended by you or us. You can end them by deleting the App. We may suspend or end your license if you violate these Terms. Sections 4 through 7 and 9 through 15 survive termination.

13. Apple App Store terms

If you downloaded the App from Apple's App Store, you and we acknowledge that:

• these Terms are between you and Arcade 51 LLC only, not with Apple Inc. ("Apple"), and Arcade 51 LLC, not Apple, is solely responsible for the App and its content;
• your license is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs, or expenses from a failure to conform to a warranty are Arcade 51 LLC's responsibility to the extent they are not disclaimed in these Terms;
• Arcade 51 LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws;
• if a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Arcade 51 LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim;
• you represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties;
• questions, complaints, or claims about the App should be sent to Arcade 51 LLC at the contact details in Section 16;
• you must comply with applicable third-party terms (for example, your wireless data service agreement) when using the App;
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

14. Google Play

If you downloaded the App from Google Play, your purchases are also governed by the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or its content.

15. Governing law and disputes

These Terms are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-law rules. Except where applicable consumer law requires otherwise, any dispute arising from these Terms or the App will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Either party may bring an individual claim in small-claims court if it qualifies. Nothing in this section limits Arcade 51 LLC's right to seek injunctive relief against infringement in any court with jurisdiction.

16. General and contact

These Terms and the App Privacy Policy are the entire agreement between you and Arcade 51 LLC about the App. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, sale, or transfer of our business. Use of arcade51az.com itself is governed by the website's Terms of Service.
